Making it a success for the government, National Assembly and Senate collectively approved the 26th constitutional amendment with two-thirds majority on October 20, 2024. Now, after the approval of the proposed amendment, the coalition government has less than 30 hours to appoint the new Chief Justice of Pakistan (CJP).
Current CJP Qazi Faez Isa is going to retire on October 25, 2024. After the approval of 26thamendment in the constitution, the parliamentary committee is empowered to appoint the new Chief Justice of Pakistan for the next fixed three years.
As per the amendment, the new appointment of CJP must be finalized by October 22, 24 till 12AM as current CJP Qazi Faez Isa is going to retire on October 25, 2024. The coalition government now has less than 30 hours to appoint the new CJP. This appointment will no longer be based on solely the seniority but the selection will be made among the three most senior judges of the Supreme Court of Pakistan.
For the selection, a 12-member parliamentary committee will be formed to decide the name of the CJP but the name requires the approval from the parliament with two-thirds majority. After the two-thirds majority, the committee will forward the selected name to the prime minister who will further send the nomination to the president for final approval.
The committee that will decide the name of the new CJP will consist of senators Azam Nazeer Tarar from Pakistan Muslim League-Nawaz (PMLN), Farooq H Naek from Pakistan People’s Party (PPP), Syed Ali Zafar from Pakistan Tehreek-e-Insaf (PTI), and Kamran Murtaza Jamiat Ulema-e-Islam-Fazl (JUI-F). Today, an in-camera meeting was held to discuss the selection of the CJP at 4PM.
It is worth mentioning here that Justice Mansoor Ali Shah is the most senior judge on the seniority list right now. He joined Supreme Court in early 2018 after severing as a chief justice in Lahore High Court for almost two years.
