Reportedly, The Judicial Commission of Pakistan (JCP) meeting will held today to discuss the appointment of eight judges to the Supreme Court. The meeting will chaired by the Chief Justic of Pakistan(CJP) Yahya Afridi.

As per details, in the meeting, the appointments of five senior judges from each of the four high courts will be discussed.

It is anticipated that two judges from both the Sindh and Islamabad High Courts, along with one judge each from the Peshawar and Balochistan High Courts, will be elevated to the Supreme Court.

On the other hand, four Supreme Court judges, including two commission members, Justice Mansoor Ali Shah and Justice Munib Akhtar, have requested to hold on the session through a letter written to the CJP.

Justice Ayesha A Malik wrote the letter and Justice Athar Minallah, called for the JCP meeting to be deferred “till the challenge to the 26th Constitutional Amendment is decided one way or the other”.

Following the 26th Amendment, the current members of the JCP include CJP Afridi, Justice Shah, Justice Akhtar, Justice Amin-ud-Din Khan, Attorney General for Pakistan Mansoor Usman Awan, Federal Minister for Law and Justice Azam Nazir Tarar, Pakistan Bar Council representative Akhtar Hussain, and parliamentary members from both the treasury and opposition benches.

It is worth mentioning here that Pakistan Tehreek-i-Insaf (PTI) Senator Barrister Syed Ali Zafar also wrote a letter to postpone the Judicial Commission of Pakistan’s (JCP) meeting held today for the appointment of eight judges to the Supreme Court.

Pakistan Tehreek-i-Insaf (PTI) Senator Barrister Syed Ali Zafar seeks Chief Justice of Pakistan (CJP) Yahya Afridi to postpone the Judicial Commission of Pakistan’s (JCP) meeting scheduled for today (Monday)

As per details, recently four Supreme Court justices called CJP Yahya Afridi to postpone the appointments until the challenges to the 26th Amendment were resolved. After days, the PTI Senator Barrister Syed Ali Zafar wrote a letter to CJP Yahya Afridi seeking CJP to hold off on appointments.

He urged CJP Yahya Afridi to postpone the commission’s meeting until the matter of seniority of judges of the Islamabad High Court (IHC) was decided and resolved.

Zafar wrote four-page letter, said, “If the commission still chooses to proceed with the meeting anyway, it should not at least consider any of the judges transferred to the IHC recently as eligible for appointment as the chief justice of the high court or the judge of the Supreme Court”

Ali Zafar emphasized in his letter said, “Judicial Commission must act with ‘heightened care’ to uphold public trust”.

He highlighted the potential issue that could arise following the JCP’s February 10 meeting, which is expected to result in Supreme Court appointments and possibly create a vacancy for the IHC chief justice. He also posed a critical question regarding which judge would be eligible for the position based on seniority.

“Justice must not only be done but also be seen to be done,” he underlined.

“There is a perception among the general public and many in the legal community that these developments may be linked to high-profile appeals filed by PTI founder Imran Khan and Mrs Imran Khan against their illegal convictions based on political victimisation, which are currently before IHC,” Mr Zafar added

“To ward off such perceptions and uphold public trust, it is important for the JCP to act with heightened care, caution, and transparency,” he further stated in his letter.

He expressed his concern over the recent transfer of the judges to IHC and the resulting controversy of seniority gave rise to objections

“It is not difficult to perceive a reality where the IHC will not now fall victim to deep and manifesting resentment between the judges,” he feared.

“The letter by sitting judges of the IHC confirms this apprehension. This too is likely to have an arresting effect on court functioning and the administration of justice.”

Syed Ali Zafar suggested to the CJP that before finalizing the fresh roster, the three most senior serving high court judges should be considered eligible for appointment as chief justice and Supreme Court judge

He called that in  Al-Jehad case had held that most senior judge of the high court has a legitimate expectancy to be appointed as the chief justice,“It is necessary to ensure that the legitimate expectancy of the judges of the high courts to be treated fairly and in accordance with the Constitution and law,”

“The effect of this transfer and the assignment of seniority done subsequent thereto has removed one sitting judge of the IHC from the list of three most senior judges,” he further wrote in letter.

“It is quite evident that this transfer and the issuance of the seniority roster violates the legitimate expectancy of not only these judges but also the other judges”, he added.

Defence Minister Khawaja Asif alleged that Pakistan Tehreek-i-Insaf (PTI) wants to repeat the events of May 9 or November 26 and the government will not allow Pakistan Tehreek-i-Insaf (PTI) to disturb the state again.

As per details, Defence Minister Khawaja Asif called the press conference at his residence in Sialkot. While speaking to the media, he criticized the Khyber Pakhtunkhwa (KPK) government for misusing the public funds for the party rallies and for anti-state agenda.

He warned the PTI not to repeat events like May 9 or November 26, and the government will not allow Pakistan Tehreek-i-Insaf (PTI) to disturb the state again, as PTI is planning to hold the protest today (Sunday).

Khawaja Asif claimed that, “The Khyber Pakhtunkhwa government is spending immense resources and wealth on the PTI rally to be held tomorrow. Millions of rupees are being spent on this rally and government employees are being forced to participate in it”.

“Government missionaries and government employees are working day and night for the success of the rally,” he added.

He recalls all the previous events in which PTI intentionally created hurdles and attempted to destroy the Pakistan’s image in the international community, said,“Whenever there is an opportunity to elevate Pakistan’s status, whether through the Shanghai Cooperation Organisation (SCO) summit or other global events, PTI launches protests,”

Khawaja Asif highlights the importance of the recent cricket event the Champions Trophy and criticized the PTI’s plans to hold protests during the Champions Trophy, stating that, “The Champions Trophy is set to take place in Pakistan, yet PTI is planning protests on Feb 18 or 19, coinciding with the event. Why are there no such rallies and processions in other provinces? PTI’s demonstrations have always been violent, and such actions cannot be allowed”.

The minister said parties should adopt political behavior,“This behaviour of PTI is unacceptable for the state of Pakistan in any way. These people are inciting the atmosphere of terrorism, which is not the right thing to do. Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur said that 99 per cent of their demands have been fulfilled, so why are they still protesting? They should be celebrating instead.”

He points out the non-serious behavior of PTI during the negotiations with the government,“They were never serious about talks. The same happened before, and the discussions led nowhere. Instead, they plan rallies whenever a significant international event is scheduled,” he added.

In response to a question, Mr Asif said, “We want good relations with the international community, but there will never be any compromise with anyone on the issue of Pakistan’s integrity and Pakistan’s honour and dignity will be given priority at all costs.”

Prime Minister’s Adviser on Public and Political Affairs Rana Sanaullah termed the letter to COAS General Munir as deliberate efforts on the side of Khan to create divisions between the military and the public or sow misunderstandings within the army’s command.

It is worth mentioning here that Imran Khan in his first letter to the army chief, had demanded to reconsider policies and called for the formation of a judicial commission.
